General Regulation

The Swedish school duty [skolplikt] is regulated in Skollagen's [School Law] 7th chapter. Every child who lives in Sweden has the duty to attend school starting the autumn semester they turn six years old. The school duty ends when the children finish grade nine.

According to Skollagen every student shall participate in the education that is organised. It is the obligation of the guardian [vårdnadshavare] to make sure that the child attends school and fulfills the school duty.

Skollagen 7:23 statutes that if a child under school duty does not fulfill his or her schooling and this is because the guardian has not done what he or she is under an obligation to do, the municipality can order the guardian to fulfill his or her obligation. This order can be combined with liquidated damages [vite]. Liquidated damages is a form of fee that can be ordered by the public authorities. Liquidated damages is regulated in lagen om viten. This law stipulates that the liquidated damage should be established to an amount, which considering the circumstances, can be assumed to make the addressee follow the order.

Application in your case

All three of your children are obliged under the school duty to attend school. It is your responsibility as their guardian to make sure your children fulfill their school duty. If you fail to do so with intent the municipality you live in can order you to send your children to school. This order can be combined with liquidated damages.

So to conclude, if you keep your children at home against the principal’s order you are risking to face liquidated damages.

Allmänna regler

Skolplikten regleras i Skollagens 7:e kapitel. Alla barn som är bosatta i Sverige har skolplikt från och med höstterminen året då barnet fyller sex år. Skolplikten avslutas när barnet avslutar årskurs nio.

Enligt skollagen ska varje elev i skolan delta i den verksamhet som organiseras. Det är vårdnadshavarens skyldighet att se till att barnet fullgör sin skolplikt.

Av skollagen 7:23 framgår att om en skolpliktig elev inte fullgör sin skolgång och detta beror på att elevens vårdnadshavare inte har gjord vad denne är skyldig att göra för att så ska ske, får hemkommunen förelägga elevens vårdnadshavare att fullgöra sina skyldigheter. Ett sådant föreläggande får förenas med vite. Vite är ett penningbelopp som en myndighet kan döma ut om någon har underlåtit att följa en myndighets beslut. Vite regleras i lagen om viten. Av den lagen framgår att vitets belopp bestäms utifrån omständigheterna i det enskilda fallet och ska uppgå till ett sådant belopp att det kan antas att adressaten kommer följa det förläggande som utfärdas.

Tillämpning

Alla dina tre barn lyder under skolplikten. Det är din skyldighet som vårdnadshavare att se till att dina barn uppfyller sin skolplikt. Om du underlåter att göra detta och trots skolplikten undervisar dina barn hemifrån, så kan kommunen utfärda ett föreläggande om att skicka dina barn till skolan. Detta föreläggande kan kombineras med vite.
