Swedish citizienship
There are five criteria that needs to be fulfilled before applying for swedish citizienship. You must
- be able to prove your identity
- be 18 years old
- have a permanent residence
- have lived here for a certain amount of time (five years, three if you're married to a swede)
- have lived a diligent life in Sweden
As far as I know, the only concern for you is that you haven't lived here long enough. As I stated above, it's normally five years (from your application for permanent residence) but if you are married to a swedish citizien it's only three. So, if you divorce, you will have to wait two more years.
Custody in case of divorce
If you divorce you will both have custody of your child, unless you have a difficulty co-operation, in which case the court will assign one of you the custody. There is however a principal rule in the swedish parental code (Föräldrabalken) that every decision regarding the child must be taken in the best interest of the child. This means that I don't know who will get custody, or if you both will. It all depends on what is best for the child. With regards to your question however, I can't see that for example the fact that you are not a swedish citizien would have any impact on the question of the best interest of the child. It is also worth noting that in Sweden we don't consider any of the sexes more fit than the other to take care of a child. Ergo, from the information I have been given, there is no conclusions to be made.
I hope that this answered your question, even if I was unable to give you a definite answer. If you have any further thoughts, don't hesitate to contact us again with another question.
Regards,
Helmer
