A practical question on a joint request for divorce: After a full consultation of a jurist, the form and instruction for a joint request to divorce was received. I was informed today that this jurist does not work at the company anymore.

I understand we each need to request the tax office for a personal identity certificate for divorce. My husband has lived in our fritidshus since end November 2016, and did not change the residence address at the tax office. If that could be a problem to grant the request, what other means are accepted to corroborate that my husband lived apart for more than 2 years?

The request is to have examples of evidence other than an extract from the population register that are accepted as referred to in the instruction form for a divorce request without time for consideration form stating: "If you have lived apart for at least 2 years you must be able to corroborate this. One method is by means of extract from the population register.

Thank you for your question and for using our service. Usually we do not respond in English, but I will try my best to answer your question. Below I will explain the answer to your question about divorce. You can find the applicable articles in äktenskapsbalken (ÄktB).

Chapter 5, section 4 (ÄktB) states that if the spouses live separately for at least two years, each of them has the right to divorce without time for consideration. As you mention, an extract from the population register is one way to corroborate that you and your husband have lived apart for at least two years. 

Another method to prove that you have lived apart, that is mentioned in a commentary on the law (Lindell och Hall, Äktenskapsbalk (1987:230) 5 kap. 4 §, Lexino 2015-07-01), is a so-called särlevnadsintyg. It is a certificate where two people who know the spouses well certify that the spouses have lived separately for at least two years. The spouses must not have been registered at different addresses for more than two years in order for the certificate to apply. The certificate can thus be used to avoid the time for consideration and get the divorce granted earlier.
